Nice Pet’s Sàrl (hereinafter “Nice Pet’s”, “we”) is the exclusive Swiss distributor of Iv San Bernard (Italy) professional care products for dogs and cats, and also distributes the Anigene hygiene range.

Art. 2 — Scope

2.1 These General Terms and Conditions of Sale (hereinafter “Terms”) govern all orders placed in the online shop www.nice-pets.ch, as well as orders sent to Nice Pet’s by email, by telephone or at a trade fair, unless otherwise agreed in writing.

2.2 By submitting an order, the customer confirms having read these Terms and accepts them without reservation.

2.3 The customer's purchasing or general terms and conditions do not apply, even if Nice Pet’s does not expressly object to them.

2.4 Nice Pet’s may amend these Terms at any time. The version applicable to an order is the one published on the website at the time the order is placed.

Art. 3 — Customers: consumers and business customers

3.1 The online shop is open to consumers (private individuals buying for personal or household use) and to business customers (grooming salons, pet shops and retailers, veterinary practices and clinics, breeders, purchasing organisations, wholesalers).

3.2 Professional sizes (1 to 10 litres) and certain technical items are intended for professional use. They are available only to business customers who have an account approved by Nice Pet’s and are logged in to it.

3.3 Opening a business account is subject to approval by Nice Pet’s, which may request supporting documents (commercial register extract, company ID, professional certificate). Nice Pet’s may refuse an application without giving reasons.

3.4 The business customer undertakes not to resell professional sizes to consumers without complying with the applicable labelling and safety requirements.

3.5 The customer must be of age and capable of judgement. Orders by minors require the consent of their legal representative.

3.6 The customer is responsible for the accuracy of their account data and the confidentiality of their login details. They must inform Nice Pet’s immediately of any misuse.

Art. 4 — Products and product information

4.1 The descriptions, photographs, contents, compositions and directions for use published on the website are provided with the greatest care but do not constitute a warranty of specific qualities within the meaning of Art. 197 CO, unless expressly stated. This reservation does not apply where a defect has been fraudulently concealed (Art. 199 CO).

4.2 Slight differences in colour, appearance or packaging compared with the images do not constitute a defect.

4.3 Cosmetic and hygiene products are intended for animals and must be used in accordance with the instructions on the packaging or product sheet. They are neither medicinal nor veterinary products and do not replace veterinary advice.

4.4 Nice Pet’s may change its range, formulas and packaging at any time and withdraw a product from sale.

Art. 5 — Prices

5.1 Prices shown to visitors and consumers are in Swiss francs (CHF), including all taxes, with Swiss VAT included at the statutory rate applicable to each product (currently 8.1% for care and hygiene products), in accordance with the Price Indication Ordinance (PIO).

5.2 Prices shown to logged-in business customers are exclusive of VAT, according to the price list assigned to their account. VAT at the statutory rate is added on invoicing.

5.3 Delivery costs are not included in product prices. They are shown separately before the order is submitted (Art. 8).

5.4 Recommended retail prices communicated to retailers and purchasing organisations are non-binding recommendations; the reseller remains free to set its own prices.

5.5 Nice Pet’s may adjust its prices at any time. The applicable price is the one displayed when the order is submitted.

5.6 In the event of an obvious pricing error (typing, decimal or display error), Nice Pet’s is entitled to refuse the order or to offer the customer to maintain it at the correct price. The customer is informed without delay and may cancel the order free of charge.

Art. 6 — Conclusion of the contract

6.1 The presentation of products on the website does not constitute a binding offer but an invitation to order.

6.2 Ordering steps — The customer selects products and adds them to the cart; opens the cart and checks the items, quantities and amounts; enters billing and delivery addresses and chooses the delivery and payment methods; reaches a summary page showing the entire order, including delivery costs and taxes; and finally submits the order by clicking the confirmation button.

6.3 Correcting input errors — Until final submission, the customer may at any time go back, change or remove items in the cart, correct quantities and amend the data entered. The summary page allows a final check of the entire order.

6.4 Confirmation — Nice Pet’s acknowledges receipt of the order promptly by email. This acknowledgement does not constitute acceptance of the order.

6.5 The contract is concluded only when Nice Pet’s confirms the order with an order confirmation or an invoice, or when it ships the goods.

6.6 Nice Pet’s may refuse or limit an order, in particular in the event of stock shortage, doubts about the customer's solvency, unusual quantities, suspected fraud or unauthorised resale. If the order has already been paid, the amount is refunded in full.

6.7 The contract text (order confirmation) is sent to the customer by email. The customer is advised to keep it. The language of the contract is the language in which the order was placed (French, German, Italian or English).

Art. 7 — Payment

7.1 Orders are paid by invoice, payable in advance. The goods are reserved when the order is placed and prepared upon receipt of payment.

7.2 Any other payment methods offered in the online shop are shown when ordering; only those displayed at that time are available.

7.3 Unless otherwise agreed in writing, no sales are made on credit terms or cash on delivery. Special payment terms may be agreed in writing with a business customer; they are then recorded in the customer's file and on their invoices.

7.4 If payment is not received within 10 days of the invoice date, Nice Pet’s may cancel the order after informing the customer.

7.5 In the event of late payment by a business customer with agreed payment terms, default interest of 5% per annum is due from the due date, without prior reminder (Art. 102 para. 2 and 104 para. 1 CO). Actual reminder and collection costs are borne by the customer.

7.6 Set-off against any claims of the customer is permitted only with the written consent of Nice Pet’s, unless the customer's claim is acknowledged or established by a court. This restriction does not apply to consumers.

Art. 8 — Delivery and shipping costs

8.1 Nice Pet’s delivers to Switzerland and the Principality of Liechtenstein. Deliveries to other countries are subject to a separate quotation; customs duties, taxes and import charges are then borne by the customer.

8.2 Delivery time: 2 to 3 weeks after receipt of payment. The stated times are indicative and are not fixed deadlines unless expressly agreed in writing.

8.3 Delivery costs in Switzerland and Liechtenstein. Delivery costs include VAT and depend on the type of customer. The threshold for consumers is assessed on the order amount including VAT; the threshold for business customers on the value of the goods excluding VAT.

CustomerDelivery costs
ConsumersCHF 9.90 – free for orders from CHF 50.–
Business customersCHF 20.– – free for goods from CHF 300.– excl. VAT

Bulky equipment (drying cabins, grooming tables) is delivered by carrier; the delivery costs are quoted to the customer before shipping.

8.4 Partial deliveries are permitted where reasonable for the customer; they do not incur additional shipping costs.

8.5 If the delivery time is exceeded, the customer's rights are governed by Art. 107–109 CO: the customer may set a reasonable additional period in writing and, if it expires without result, withdraw from the order. If the order was paid in advance and is not delivered, the amount paid is refunded in full.

8.6 If the goods cannot be delivered because the customer is absent, the address is incomplete or the parcel is not collected within the period set by the carrier, the costs of return and re-shipment are borne by the customer.

Art. 9 — Transfer of risk and transport damage

9.1 For deliveries to a consumer, the risk of loss or damage passes to the customer upon actual handover of the goods.

9.2 For deliveries to a business customer, risk passes to the customer when the goods are handed over to the carrier.

9.3 Any transport damage must be reported immediately to info@nice-pets.ch, if possible within 48 hours of receipt, with photographs of the parcel and its contents. The customer keeps the packaging until the case has been dealt with. Late notification may prevent the carrier from accepting liability; it does not, however, cause the consumer to lose their rights under the statutory warranty for defects.

Art. 10 — Retention of title

The goods delivered remain the property of Nice Pet’s Sàrl until the price has been paid in full. However, retention of title takes effect only once entered in the register of retention of title agreements kept by the debt enforcement office at the customer's domicile (Art. 715 para. 1 CC). The customer undertakes to cooperate with this registration and to provide the necessary information.

Art. 11 — Inspection of goods, notice of defects and warranty

11.1 The customer inspects the goods upon receipt.

11.2 Business customer: obvious defects must be notified in writing to info@nice-pets.ch within 7 days of receipt; hidden defects immediately after their discovery. Otherwise, the goods are deemed accepted (Art. 201 CO).

11.3 Consumer: defects must be notified as soon as they are discovered.

11.4 Warranty period:

  • Consumers: 2 years from delivery, in accordance with Art. 210 para. 1 and 4 CO. This period cannot be shortened and is not shortened by these Terms.
  • Business customers: 12 months from delivery, limited by the expiry date shown on the product.

11.5 Consumer: in the event of a defect, the customer exercises the rights conferred by Art. 205 and 206 CO — rescission of the sale, price reduction or, for generic goods, delivery of other items of the same kind. Nice Pet’s first offers replacement of the item; if the customer accepts, they waive the other remedies to that extent.

11.6 Business customer: Nice Pet’s chooses between replacement of the goods, price reduction and refund. Rescission of the contract is reserved for material defects.

11.7 The warranty does not cover: normal wear and tear; damage resulting from improper storage (heat, frost, exposure to sunlight), use not in accordance with the instructions, mixing with other products or incorrect dilution; products past their expiry date; individual reactions of an animal to a correctly used product.

11.8 Appliances and machines are covered by the manufacturer's warranty, the terms and duration of which are stated on the product sheet or in the enclosed documentation.

Art. 12 — Returns, exchanges and cancellation

12.1 Swiss law provides no right of withdrawal or return for online purchases. The right of withdrawal under Art. 40a et seq. CO covers doorstep selling and contracts concluded by telephone, and does not apply to the online shop.

12.2 Nice Pet’s does not take back items delivered in accordance with the order, whether or not they have been opened: for reasons of hygiene and safety, a returned care or hygiene product cannot be resold. Every order is final, for consumers and business customers alike. The handling of defective, incorrect or damaged goods is described in the Return and Refund Policy, which forms an integral part of these Terms.

12.3 An order that has already been shipped can no longer be cancelled.

12.4 Telephone orders. Where Nice Pet’s has contacted a consumer by telephone without being asked to and the order exceeds CHF 100, the consumer has a 14-day right of withdrawal within the meaning of Art. 40a et seq. CO. This right does not exist where the customer requested the negotiations themselves (Art. 40c let. a CO), nor for orders placed at a fair or trade-show stand (Art. 40c let. b CO). Withdrawal must be declared in writing to info@nice-pets.ch.

Art. 13 — Liability

13.1 Nice Pet’s is liable for damage caused intentionally or through gross negligence; any clause to the contrary would be void (Art. 100 para. 1 CO). Nor can its liability for personal injury be excluded or limited (Art. 8 of the Federal Product Liability Act).

13.2 To the extent permitted by law, liability for indirect and consequential damage — loss of profit, loss of customers, business interruption, third-party claims — is excluded. Towards consumers, liability for direct damage resulting from slight negligence is limited to the amount of the order concerned.

13.3 To the extent permitted by law, Nice Pet’s is not liable for damage resulting from improper use of the products, failure to follow the instructions for use or safety instructions, or use on an animal with a pre-existing condition not reported to a veterinarian.

13.4 Liability under the Federal Product Liability Act remains reserved.

13.5 Nice Pet’s is not liable for delays or impediments due to force majeure (natural disasters, epidemics, strikes, government measures, supply disruption at the manufacturer, prolonged failure of transport or communication networks).

13.6 To the extent permitted by law, Nice Pet’s makes every effort to ensure the availability of the website, without guaranteeing uninterrupted or error-free operation, and accepts no liability for technical interruptions.

Art. 14 — Chemicals and biocidal products

14.1 Certain hygiene and disinfection products (in particular the Anigene range) are subject to chemicals and biocidal products legislation.

14.2 Nice Pet’s provides business customers, on request and at the latest with the first delivery, with the safety data sheet (SDS) for the products concerned, in the official Swiss language of their choice.

14.3 The business customer undertakes to comply with the information in the SDS and on the label, to train its staff accordingly, and not to supply these products to the public other than under the conditions provided by law.

Art. 15 — Intellectual property

15.1 All website content — texts, photographs, illustrations, videos, product sheets, layout, logos and trademarks — is protected. The trademarks Iv San Bernard, Anigene and Nice Pet’s belong to their respective owners.

15.2 Any reproduction, distribution or commercial use of this content without the prior written consent of Nice Pet’s or the rights holder is prohibited.

15.3 Nice Pet’s makes product images and texts available to its resellers for the promotion of items purchased from it. This authorisation is limited to that use and may be revoked at any time.

Art. 16 — Data protection

The processing of personal data is described in the Privacy Policy, which forms an integral part of these Terms.

Art. 17 — Severability

If any provision of these Terms is or becomes void, unlawful or unenforceable, the validity of the remaining provisions is not affected. The provision concerned shall be replaced by a valid provision whose economic effect comes as close as possible to that intended.

Art. 18 — Applicable law and place of jurisdiction

18.1 These Terms and all contracts arising from them are governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) and the conflict-of-laws rules.

18.2 For business customers, the exclusive place of jurisdiction is the registered office of Nice Pet’s Sàrl in St-Légier-La Chiésaz (Canton of Vaud).

18.3 The jurisdiction clause in section 18.2 does not apply to consumers, who cannot waive their statutory place of jurisdiction in advance (Art. 35 para. 1 let. a CPC). Consumers may bring proceedings at the courts of their domicile or of the registered office of Nice Pet’s; Nice Pet’s may bring proceedings against them only before the court of their domicile (Art. 32 para. 1 CPC).

18.4 These Terms exist in French, German, Italian and English. In the event of any discrepancy between the versions, the French version prevails.
